Homeland Security was formed in 2002, in response to 9 - 11, thankfully when the office was created, they did create provisions to prevent the department from trampling over citizen’s Rights. In the Homeland Security Regulations Title 6 Section 345, there is a requirement to have an Officer for Civil Rights and Civil Liberties. If we look at Title 6 Section 345 - Sub-Sections 4 and 5 we can see it states the following:
Title 6 Section 345"(4) oversee compliance with constitutional, statutory, regulatory, policy, and other requirements relating to the civil rights and civil liberties of individuals affected by the programs and activities of the Department;
(5) coordinate with the Privacy Officer to ensure that—
(A) programs, policies, and procedures involving civil rights, civil liberties, and privacy considerations are addressed in an integrated and comprehensive manner; and
(B) Congress receives appropriate reports regarding such programs, policies, and procedures; and
(6) investigate complaints and information indicating possible abuses of civil rights or civil liberties, unless the Inspector General of the Department determines that any such complaint or information should be investigated by the Inspector General."
In layman’s terms, Homeland Security is supposed to have an officer who’s job is makes sure the department isn’t violating anyone’s Constitutional or Civil Rights. The

What’s supposed to happen is the Officer For Civil Rights is supposed to make sure the Disinformation Governance Board isn’t violating anyone’s Rights. Since Free Speech on The Internet is A Constitutional Right, including hate speech, it’s unclear what crime the Disinformation Governance Board is going to be able to charge people with.
In situations like this, the Government and Law Enforcement, will try and take advantage of someone’s ignorance of the law, and lack of knowledge about their Rights, and try and coerce them into confessing to a crime, that really isn’t a crime. If you’re a person of modest means, who can’t afford access to quality legal representation, it would be extremely easy for law enforcement to use scare tactics, and convine you that you have comitted a serious offense and are looking at doing hard time if you don’t cooperate and sign a confession right now.
So the next time Nina Jankowicz starts tweeting about misinformation or hate speech, drop a link reminding her, about Reno v. ACLU and how The Supreme Court Unamously decided The Internet was a Free Speech Zone and that Hate Speech is Protected Under The First Amendment. That should cause her to start complaining people are harassing her online, again…
